Hutch's RV Park Site Service Agreement

This site service agreement (the “Agreement”) is made and entered into to be effective as of the last date written below (the “Effective Date”) by the undersigned parties. All adult parties must initial and sign.
RV Site
Hutch's RV Park (“RV Park”) hereby provides services on the assigned RV Site of the RV Park at 1009 Davis Drive in Searcy, Arkansas 72143.
Number of Occupants
Guest agrees that the site shall be occupied by no more than 6 adults and 4 children under the age of 5 years old, without the written consent of the RV Park.
Arriving
RV Check-In time is 1:00 PM – 6:00 PM Sunday–Friday. Cabin Check-In is between 3:00 PM – 6:00 PM Sunday–Friday. Late arrivals will be accepted on a case-by-case basis and are subject to a Late Check-In fee. RV PARK DOES NOT ALLOW CHECK-INS AFTER DARK.
Park Rates
- Current rates for reservations can be found at hutchsrv.com/reserve. All fees are due prior to the beginning of your reservation.
- For extended stays (up to a maximum of 30 days), please email Hutch@Hutchsrv.com for a rate quote.
Cancellation Policy
Any deposits are non-refundable. A 30-day notice is required to cancel a reservation. All cancellations are subject to an additional $25.00 Cancellation Fee. No Call/No Shows will be charged up to the balance of the reservation, plus the $25.00 Cancellation fee.
Rules and Regulations
Guest and their visitors, invitees and all occupants shall comply with the written rules and regulations provided to Guest, posted at the RV Park and/or found at hutchsrv.com/rules-and-policies (collectively the “Rules”). Failure to adhere to the Rules may result in Guest's removal from the RV Park without a refund. Guests MUST sign in at the RV Park office upon entry or when the office is open, if not available during Check-In.
Pickleball/Basketball Courts
ALL children under the age of 18 must always be accompanied by an adult while enjoying the Pickleball/Basketball Courts and Rec Room.
RV Park's Right to Terminate
RV Park may terminate this Agreement for any or no reason by providing Guest a notice to vacate (“Notice to Vacate”). Guest agrees to render peaceful possession of the RV Site within three (3) days of the Notice to Vacate. Upon Guest's peaceful surrender, RV Park will refund the proportionate amount of any unused Fees previously paid.
Early Termination by Guest
RV Park may recover and/or retain as damages for Guest's early termination an amount equal to the outstanding Fees for the Term, plus RV Park's court costs and legal fees.
Default by Guest
The following constitute defaults (“Acts of Default”):
- Failure to timely pay Fees when due.
- Giving false information on any application.
- Failure to comply with the Rules or any term of this Agreement.
- Serious misconduct or criminal acts, in the sole discretion of management.
- Holding over after giving or receiving notice of termination.
Additional Terms
- Condition of RV Site: Guest agrees to surrender the RV Site in a neat and clean condition upon termination or expiration.
- Assignment: Guest shall not assign or sublet the RV Site.
- Governing Law: This Agreement is governed by the laws of the State of Arkansas.
- Attorney Fees: In any legal proceedings, RV Park may collect reasonable costs and attorney fees from Guest.
- Theft of Service: According to Arkansas Penal Code Section 31:04(b), any guest who leaves without paying or refuses to pay is subject to criminal prosecution.

Waiver of Liability & Release of Claims
Guest acknowledges and agrees that Guest's presence on the RV Park and RV Site and participation in any activities will involve inherently dangerous or hazardous activities and conditions, both known and unknown, that could lead to personal, bodily or mental injury, damage to property, serious illness, sickness, disease, burns, drowning, broken bones, and/or death.
Waiver of Liability and Release of Claims
By executing this Agreement, the undersigned Guest, on behalf of himself/herself, his/her spouse, family, heirs, visitors, invitees, personal representatives, estate, successors and assigns, does hereby waive, release, relinquish, acquit, forever discharge and covenants not to sue Hutch and Hutch Land and Property, LLC DBA Hutch's RV Park, its owners, members, managers, officers, contractors, employees, successors and assigns, agents, and any other invitees on the RV Park (collectively the “Released Parties”), of and from any and all claims, losses, expenses, judgments, attorney fees, fines, penalties, demands, damages, liabilities and causes of action, known and unknown, arising out of or related to the Guest's presence on the RV Park or participation in any activities, including claims caused in whole or in part by the negligence or gross negligence of any of the Released Parties.
The Guest understands and confirms that by signing this waiver, he/she has voluntarily given up considerable future legal rights. Each Party has signed this Agreement freely, voluntarily, under no duress.
This agreement does not constitute a landlord/tenant agreement. Payment for an RV Site is entirely for services rendered under a host/guest arrangement.
Animal Waiver
Guest hereby agrees to the following regulations and conditions relating to all pet(s) while staying at the RV Park.
Excluded Dogs
The RV Park has the sole discretion to exclude dogs and/or other animals. Exclusion may be based on breed, age, health, behavior, or temperament.
The following breeds are specifically excluded:
Doberman Pinscher, Pit Bull, Rottweiler, Chow Chow, Wolf Dogs & Wolf Hybrids, Presa Canario, Akita, German Shepherd, Husky, Mastiff, Alaskan Malamute, Bullmastiff, Caucasian Shepherd, or a mixed breed of those aforementioned.
Other Prohibited Animals
- Exotic Pets: Snakes, spiders, large birds, reptiles, etc.
- Farm Animals: Cows, pigs, goats, sheep, chickens, etc.
- Saddle Animals: Horses, donkeys, mules, etc.
Small mammal exception: Your pet bunny rabbit might qualify! Send a pic to hutch@hutchsrv.com with your request.
Supervision
Dogs must be on a leash or in a carrier in all areas of the RV Park, except the off-leash dog park. Dogs must be with the Guest or a designated individual at all times and may not be left unattended at the RV Site. Guest agrees to prevent noise or any other disturbance.
Vaccinations
Guest represents and warrants that all dogs are up to date on all vaccinations (including rabies and distemper) and flea treatments.
Disturbances
Should a pet create disturbances causing complaints, Guest will immediately arrange alternative housing outside the RV Park. Failure to do so will result in Guest being asked to leave without a refund.
Assumption of Risk
Permission to have pets is a privilege, not a contractual right. Guest assumes all responsibility of risks, injury, damage, and other harm that may occur while Guest's pet is at the RV Park. Guest releases all Released Parties from any and all claims arising from the pet's presence, including claims caused by negligence of the Released Parties.
